§ 6-27. Violation of State Construction Code.

  • (a)

    A person, including an officer, director or employee of a corporation, or a governmental official or agent charged with the responsibility of issuing permits or inspecting buildings or structures who does any of the following shall be in violation of the State Construction Code, being Public Act No. 230 of 1972 (MCL 125.1501 et seq.) and rules or regulations promulgated pursuant to such act, which violations are designated as municipal civil infractions pursuant to section 23 of such act (MCL 125.1523) and shall be subject to the sanctions provided in section 1-7:

    (1)

    Knowingly violates Public Act No. 230 of 1972 (MCL 125.1501 et seq.) or the State Construction Code or a rule for the enforcement of such act or code.

    (2)

    Knowingly constructs or builds a structure or building in violation of a condition of a building permit.

    (3)

    Knowingly fails to comply with an order issued by an enforcing agency, a construction board of appeals, a board, or the commission pursuant to such act or code.

    (4)

    Knowingly makes a false or misleading written statement, or knowingly omits required information or a statement in an inspection report, application, petition, request for approval, or appeal to an enforcing agency, a construction board of appeals, a board, or the commission.

    (5)

    Knowingly refuses entry or access to an inspector lawfully authorized to inspect any premises, building or structure pursuant to such act or code.

    (6)

    Unreasonably interferes with an authorized inspection.

    (7)

    Knowingly issues, fails to issue, causes to be issued, or assists in the issuance of a certificate, permit or license in violation of such act or a rule promulgated under such act or under the State Construction Code or other applicable laws.

    (8)

    Having a duty to report violations of such act or a rule promulgated under such act or under the State Construction Code or other applicable laws, knowingly conceals a violation.

    (b)

    With respect to violations of subsection (a)(3) of this section, each day that the person fails to comply with a stop construction order validly issued by an enforcing agency and for each week that the person fails to comply with any other order validly issued by an enforcement agency shall constitute a separate offense.

    (c)

    With respect to violations of subsection (a)(1) or (4) of this section, each knowing violation and each false or misleading written statement or omission of required information or statement, knowingly made in an application, petition request for approval or appeal, shall constitute a separate violation.

    (d)

    With respect to violations of subsection (a)(2) of this section, each knowing violation of a condition of a building permit shall constitute a separate violation.

    (e)

    With respect to any other violation, each day that a violation occurs or continues shall constitute a separate violation.
