Article 600.9. ELIMINATION OF NONCONFORMING STRUCTURE OR USES


SECTION 600.9:1

(1)

In accordance with Act 207, PA 1921, as amended, the City may acquire by purchase, condemnation, or otherwise, private property for the removal of nonconforming uses and structures, provided that the property shall not be used for public housing.

(2)

The City Council may in its discretion provide that the cost and expense of acquiring such private property be paid from general funds, or the cost and expense or any portion thereof may be assessed to a special district.

(3)

The City Council shall have the authority to institute and prosecute proceedings for the condemnation of nonconforming uses and structures under the power of eminent domain in accordance with the laws of the State or provisions of the City Charter relative to condemnation.
